Michael Flynn Threatens to Withdraw His Guilty Plea

Former national security adviser Michael Flynn was looking to withdraw his guilty plea and filed a motion in court.  Flynn pleaded guilty in 2017 in a case that started with the special counsel’s investigations.  The decision derives from Flynn’s attorneys, who accused the prosecution of “the government’s bad faith, vindictiveness and breach of the plea agreement.”

Prosecutors wanted Flynn to get a sentence of up to six months in jail and made a move less than a week ago.  Flynn’s new legal team is working on evidence, which leads them to believe Flynn was forced to lie by the prosecution team.  This is a game-changer and shows corruption within the system.

Originally, Flynn’s guilty plea came in the December 2017 hearing and said he lied to federal investigators concerning the discussions he and the Russian Ambassador Sergei Kislyak.  The discussions happened between the changing of presidents after the 2016 Presidential election.

He worked out a deal with prosecutors to assist formal special counsel Robert Mueller’s investigation concerning the Russian interference in the 2016 election.  In the latter part of 2018, Flynn’s sentencing hearing was abandoned.  Flynn’s attorney was replaced and worked to prove his innocence.

In the court documents which were filed this past Tuesday evening, Flynn’s attorneys noted the government pushed Flynn into giving “false” testimony.  According to ABC News reports, the government wanted Flynn to say, “he knew and intended to sign false filings in his Turkish lobbying work, which would lead him to breach his plea agreement by not telling the truth.”

The evidence showed after Flynn switched his legal team, the government demanded the “false” testimony.  Flynn’s defense team wrote, “The prosecution has shown abject bad faith in pure retaliation against Mr. Flynn since he retained new counsel.  This can only be because, with new, unconflicted counsel, Mr. Flynn refused to lie for the prosecution.”  They added, “In pure spite, the government retaliated and sought to rescind its judicial admissions that Mr. Flynn was not a co-conspirator of Rafiekian’s.”

It turned out that Flynn did not testify at his partner’s trial.  When the prosecution had their doubts about Flynn cooperating, the judge threw the case out the window after the verdict came in from the jury stating Flynn was “guilty.”  The reason was due to “lack of evidence” in the case.

The reason the prosecution became “vindictive” was because they felt Flynn’s “affirmative efforts to undermine” the prosecution, Flynn deserved harsher sentencing as they pushed for six months behind bars.

Inside the court filing, the prosecution wrote, “The government has reason to believe, through representations by the defendant’s counsel, that the defendant has retreated from his acceptance of responsibility in this case regarding his lies to the FBI.”

The new court filing from Tuesday has Flynn’s lawyers who wrote about “extraordinary developments” came to light within the previous month.  They are requesting more time to work with the new information.

In December of 2018, prosecutors wanted to give Flynn a lesser sentence than what the mandate calls for.  They offered him a deal with no jail time due to the assistance Flynn provided and the cooperation he gave to the special counsel’s team.  Flynn sat in for interviews with the prosecution team, who filed charges on his former business partner Bijan Rafiekian and accused him of being a foreign agent for Turkey.

The federal court was scheduled to give Flynn his sentencing, but Flynn pulled out of the hearing.  Judge Emmet Sullivan leaned more toward giving Flynn a sentence with jail time, and Flynn backed out.  Smells like a setup!

Michael Flynn’s new legal team has pushed the government aggressively to hand over information that was withheld from their client.  This case has turned into a battle that seems to have “government conspiracy” written all over it.

When asked to explain why the prosecution backed out on their word and why the sentencing has been revised, they said it was because Flynn was not sufficing in his cooperation within his partner’s case.  The prosecution called it “trying to thwart the government’s case.”

There have been new dates added to this case.  Flynn’s attorneys are requesting a “continuance of a sentencing date on January 28.”  They are also seeking Judge Sullivan to “hold the sentencing hearing on February 27.”  This will give them more time to rebuild their case for a lesser sentence, which Flynn was promised.  Perhaps someone behind the scenes of the government is pulling a puppet’s strings.  Who knows?

  1. Good Lord, the FBI is now crying about someone lying TO them…what about the FBI DOING the lying? Turn Flynn loose!

    1. Not only should they let him go, they should reimburse him for all the money that he lost from salary but all he lost for legal bills. This hero has suffered enough and should be made whole again.

  2. My opinion on the rat bastards who lied to Flynn in the first place should be the ones not only going to jail but from there to the gallows. It would be GREAT to bring back hanging s in the public square so that other POS COULD PREPARE FOR THE JUDGMENT.

  3. As a great war fighter the fbi lied and covered it up.He should immediately be allowed to change his plea and the case should be dismissed.Then Mr Flynn should sue the government and specifically the agents that lied.

  4. The General should be allowed to change his plea, and those who worked to take down this patriot should be charged with Treason and hanged. the General should be immediately PARDONED by the President, and WE THE PEOPLE should be allowed to honor this great man.

  5. This is one of those things engineered by former President Obama to punish General Flynn. When Obama and the General parted ways, it was reported by some outlets, that Obama promised the General that he (Flynn) would never work in Washington again.
    Seems to me that all that transpired since is nothing more than Obama’s agents making sure that that promise is kept.
    It is my belief that Muller along with Deputy AG Ronstentein have made sure that General Flynn will be non grata in the corridors of Washington.
    Whatever the case, the career of a brilliant patriot and warrior has been destroyed by the vindictiveness of smaller, insignificant people not fit to shine the General’s boots.

  6. Gen Flynn was set up by a criminally corrupt FBI who ignored initial 302s submitted by agents who interviewed Flynn who thought he was not intentionally lying. Someone later “EDITED” the 302s to set-up Flynn. I believe Peter Stzruk was involved in this “editing.” This was a set-up by political adversaries of Trump within the DOJ/FBI. Gen Flynn should not accept a pardon but should go for exoneration on all charges. The criminals in the FBI who set this up should go to prison and Gen Flynn should be allowed to file for damages against the DOJ/FBI. Until Barr fires Wray and removes the political partisans in the DOJ/FBI who TO THIS DAY continue to protect Hillary Clinton and the FISC abuses that occurred under the Obama administration, the damage done to the trust citizens have in the DOJ/FBI will not be repaired. If Barr doesn’t act soon the damage may be PERMANENT.

  8. General Flynn should be exonerated and anyone in the FBI who helped to frame him should be not only fired but precuted to the fullest extent of the law times two. They have damage the fine institution of the FBI that was corrupted first by Hillary Clinton and subsequent Democrat regimes including Loretta Lynch and other Obama surregets.

    He knows he got screwed and the whole country knows that it is true.
    The man was a hero and the many years he had served our country and given his life and his family to the American people.
    Now is the time to give general Flynn the respect that he has earned and deserved by our government.
    But hell no Comey went after him because he was a member of the Trump administration and knows to much. So Comey set him up and changed the 302s to make him look like a traitor.
    So Comey should now be tried for treason and lying about general Flynn.
    They went after him and his family and broke him of all his money and the things that he worked so hard for him and his family.
    The American people should start a go fund me page for him and his family and their legal services.
    He should sue the government. The FBI and James the lier Comey to also restore his life back to were he was before Comey and his group of criminals that set general Flynn up .
    So now the American people should demand that this man be freed from this bullshit charges and given his rank and his dignity and the honor that they took from him.

  15. I don’t understand why he hasn’t already withdrawn his guilty plea. His plea was based on a threatened house of cards presented by the FBI that is already tumbling down. The FBI has been shown to be an army of government paid liars. The FBI should be disbanded and never reopened. Don’t EVER talk to an FBI agent. They will distort everything you say and make you look like a Russian agent, or worse!!!

  17. What has happened to General Flynn is what happens everyday in courts throughout this nation, where innocent people are pressured into accepting plea deals which are ALWAYS bad for them and which the prosecutors ALWAYS renege on.

    Here in Jacksonville Florida the imprisonment of poor, mainly black, people is BIG BUSINESS. The downtown pretrial detention facility is kept full so that the city can collect the $20 fee plus $2 per day paid by each inmate.

    They also receive $ from the Federal government for each night a bed is occupied, so there is the profit motive to arrest and jail as many as possible daily. For instance if you have a hearing on Monday, even if this is the first court hearing that you have ever received and as such there is no reason to believe that you will not turn up for your Monday hearing, police officers will kick the door to your home in on Friday to arrest you, so you can spend Friday, Saturday, and Sunday night in jail before your Monday appearance and the city can make money for the 3-night occupancy of the bed you slept those nights upon.
